Welcome to EN OmeTV. These Terms of Service ("Terms", "Agreement") constitute a legally binding contract between you ("User", "you", or "your") and EN OmeTV ("we", "us", "our", or the "Platform"). These Terms govern your access to and use of the OmeTV website, random video chat applications, text messaging services, and any other software or features provided by us (collectively, the "Services").

Please read these Terms carefully before accessing or using our Services. By clicking "Start", accessing the site, downloading our mobile applications, or otherwise interacting with the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you are expressly prohibited from using the Services and must discontinue access immediately.

1. Eligibility and Age Restrictions

The OmeTV platform is intended solely for adult users. You must be at least eighteen (18) years of age, or the age of legal majority in your specific jurisdiction (whichever is greater), to access, register, or use our random video chat services. Use of the Services by anyone under the age of 18 is strictly prohibited.

By using the Platform, you represent and warrant that you meet all eligibility requirements. We reserve the right to request proof of age at any time. If we determine or reasonably suspect that you are under the required age, we will immediately terminate your access, ban your IP address, and may report the incident to appropriate child safety organizations or law enforcement agencies.

2. Description of the Services

OmeTV provides an online platform that facilitates real-time, peer-to-peer (P2P) video, audio, and text communication between random users globally. The platform utilizes advanced matchmaking algorithms to pair users based on selected filters, such as gender and geographic location.

We are a neutral intermediary connecting individuals. Because interactions happen live and instantaneously, we do not pre-screen, endorse, or guarantee the behavior, identity, or statements of any user you encounter on the Platform. Your use of the random video chat functionality is completely at your own risk. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice to you.

3. User Account and Registration

While basic access to the random cam chat may be available without an account, certain advanced features (such as social networking, photo uploads, and VIP status) require registration. If you create an account, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You may not transfer, sell, or rent your account to any third party. If you suspect unauthorized access to your account, you must notify us immediately at [email protected].

4. Acceptable Use and Community Standards

We are committed to maintaining a safe, enjoyable, and respectful environment for all users. You agree to use the Services only for lawful purposes and in accordance with our Chat Rules. You explicitly agree NOT to engage in any of the following activities:

• Illegal Activities: Using the Platform to commit or promote any unlawful act, including the distribution of illegal substances, weapons, or terrorism.
• Harassment and Abuse: Engaging in bullying, stalking, intimidation, extortion, threats of violence, or hate speech directed at any individual or group.
• Sexual Content and Nudity: Broadcasting explicit sexual acts, pornography, full or partial nudity, or exposing genitalia on camera in the public matching pool.
• Non-Consensual Acts: Capturing, recording, screen-recording, or distributing the video or audio feed of another user without their explicit, prior consent.
• Spam and Commercial Use: Transmitting unauthorized advertising, promotional materials, affiliate links, or utilizing bots/scripts to artificially interact with the platform.
• System Interference: Attempting to hack, disrupt, reverse-engineer, or overwhelm our servers, or bypassing our moderation and ban mechanisms (e.g., using VPNs to evade an IP ban).

We actively monitor the platform using AI technology and human moderators. Violation of these rules will result in immediate termination of your access, permanent bans, and potential legal action.

5. User-Generated Content (UGC)

When you use the video, audio, and text chat features of OmeTV, you are creating User-Generated Content ("UGC"). You retain all ownership rights to your UGC. However, by broadcasting on the Platform, you grant us a worldwide, non-exclusive, royalty-free, sub-licensable, and transferable license to route, transmit, display, and temporarily process your video and audio feeds solely for the purpose of operating the Services.

You represent and warrant that you have all necessary rights to broadcast the content you display. We do not actively record or permanently store your private 1-on-1 video streams on our servers. However, automated moderation tools may temporarily capture frames of your feed to detect severe violations (such as illegal content), which may be retained for safety reviews.

6. Virtual Items, VIP Status, and Payments

OmeTV may offer premium features, subscriptions, or VIP status for purchase. If you choose to purchase these features, you agree to pay all applicable fees and taxes. All transactions are processed through secure, third-party payment providers (e.g., Google Play, Apple App Store, Stripe).

No Refunds: All purchases of digital content, VIP access, or virtual items are final and non-refundable, except as required by applicable law. Virtual items have no real-world monetary value and cannot be exchanged for cash. If your account is banned due to a violation of these Terms, any remaining VIP time or virtual currency will be immediately forfeited without compensation.

7. Intellectual Property Rights

All content, software, design, text, graphics, logos, algorithms, and technical architecture comprising the OmeTV Platform are the exclusive property of OmeTV and its licensors, protected by international copyright, trademark, and intellectual property laws. You are granted a limited, personal, non-commercial license to access the Platform. You may not copy, reproduce, distribute, reverse-engineer, or create derivative works from our intellectual property without our express written consent.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, OMETV DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT GUARANTEE THE ACCURACY OR SAFETY OF ANY CONTENT BROADCAST BY OTHER USERS.

9. Limitation of Liability

IN NO EVENT SHALL OMETV, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (C) UNAUTHORIZED ACCESS TO YOUR TRANSMISSIONS OR CONTENT. IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE PAST SIX MONTHS.

10. Indemnification

You agree to defend, indemnify, and hold harmless OmeTV and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (i) your use of the Services; (ii) your violation of these Terms; (iii) your violation of any third-party right, including copyright or privacy rights; or (iv) any claim that your User-Generated Content caused damage to a third party.

11. Governing Law and Arbitration

These Terms shall be governed by and construed in accordance with the laws of the United States. Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA). You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice by updating the effective date at the top of this page. Your continued use of the Services after any changes become effective constitutes your acceptance of the new Terms.
